This English version is provided for convenience. In the event of any discrepancy, the French version (Conditions Générales d'Utilisation) prevails.
Preamble
These Terms of Use (hereinafter the "Terms") govern the use of the Five Angels mobile application and of the five-angels.com website, published by Oraklia Technologies SAS, a simplified joint-stock company with a share capital of €5,000, whose registered office is located at 497 route de Nice, 06560 Valbonne, France. Five Angels is a trademark published by Oraklia Technologies SAS.
Use of the application and the website implies full and unreserved acceptance of these Terms. Oraklia Technologies SAS reserves the right to amend them at any time. Users are invited to consult them regularly.
Article 1 - Description of the service
Five Angels is a personal safety mobile application available on iOS (App Store) and Android (Google Play). It offers two main modes:
Alert mode: Manual triggering of an alert that instantly notifies up to 5 guardian angels designated by the user, with real-time transmission of the GPS position and recording of video/audio sequences transmitted to secure servers.
Preventive mode: Continuous monitoring of the sound environment by artificial intelligence, with automatic triggering of an alert when a danger signal is detected (screams, aggression, distress). This mode requires explicit activation by the user.
Guardian dashboard: A dedicated interface allowing guardian angels to view the real-time position, receive the video streams and indicate that they are intervening.
Geographic premium: A feature allowing partner organisations (companies, municipalities, events) to automatically offer the highest level of protection to users entering their covered areas.
Article 2 - Access conditions
2.1 Account creation
Use of the application requires the creation of a personal account. The user must:
- ·Be at least 15 years old (for minor users, aged 15 to 17, the consent of the holder of parental authority is required)
- ·Provide accurate and up-to-date information
- ·Keep their login credentials confidential
The user is solely responsible for any use of their account.
2.2 One account per person
Each user may create only one account. Creating multiple accounts, using false identities or impersonating another person is strictly prohibited.
Article 3 - Protection circle
The user may invite people ("guardian angels") to join their protection circle. By accepting the invitation, the guardian angel:
- ·Consents to receive alerts and notifications from the user
- ·Agrees to access the user's location data and video streams during alerts
- ·May refuse or withdraw their participation at any time
The user must obtain the explicit consent of their guardian angels before adding them to their circle.
The user chooses at any time which of their guardian angels are active, up to 5 at the same time. The others are paused: they remain members of the circle, receive no alerts and have no access to any of the user's data until they are reactivated. Reactivation does not require new consent from the guardian angel, whose initial acceptance applies for the whole duration of the relationship.
Article 4 - Subscriptions and pricing
4.1 Free version
A free version of the application is available with limited features, the details of which are specified in the application.
4.2 Premium subscription
Advanced features are available through a paid subscription taken out directly via the App Store or the Google Play Store, under their respective terms and conditions. Current prices are displayed in the application.
4.3 Geographic premium
Partner organisations may offer premium access to users within their covered areas. This service is provided free of charge to the end user and is subject to the conditions agreed between Oraklia Technologies SAS and the partner organisation.
4.4 Refunds
Refunds are subject to the policies of the App Store and the Google Play Store. Oraklia Technologies SAS is not directly involved in payment transactions.
Article 5 - User obligations and responsibilities
The user undertakes to:
- ·Use the service in good faith and for legitimate personal safety purposes
- ·Not trigger alerts abusively, falsely or maliciously
- ·Not attempt to circumvent the security measures of the service
- ·Not use the service for illegal purposes or purposes contrary to public order
- ·Ensure that their guardian angels have consented to their role
- ·Keep their telephone number and contact details up to date
Any abusive use (repeated false alerts, harassment of guardians, attempted fraud) may result in the immediate suspension or termination of the account, without prejudice to any legal proceedings.
Article 6 - Limits of liability of Oraklia Technologies SAS
6.1 An assistance service, not a substitute
Five Angels is a personal safety aid. Under no circumstances does it replace the official emergency services (in France: SAMU 15, Police/Gendarmerie 17, Fire brigade 18, European number 112). In the event of immediate danger, the user must contact the emergency services.
6.2 Network dependency
The service requires an active internet connection to work. Oraklia Technologies SAS cannot be held liable for failures related to the absence or degradation of the network connection.
6.3 Service availability
Oraklia Technologies SAS strives to ensure that the service is available 24 hours a day, 7 days a week, but cannot guarantee uninterrupted availability. Maintenance may cause temporary interruptions, announced where possible.
6.4 Responsiveness of guardians
Oraklia Technologies SAS cannot guarantee the responsiveness or the actual intervention of the guardian angels designated by the user.
6.5 Limitation of liability
To the extent permitted by applicable law, the liability of Oraklia Technologies SAS is limited to proven direct damage resulting from its own fault. Oraklia Technologies SAS shall not be held liable for indirect damage, loss of business or harm resulting from the use of, or the inability to use, the service.
Article 7 - Personal data
The processing of personal data is governed by our Privacy Policy, accessible from the application and the website, and complies with the General Data Protection Regulation (GDPR - EU 2016/679).
Article 8 - Intellectual property
The Five Angels application, its content, trademarks, logos, algorithms and source code are the exclusive property of Oraklia Technologies SAS and are protected by intellectual property law. Any unauthorised reproduction, modification or exploitation is prohibited.
The user is granted only a personal, non-exclusive, non-transferable and revocable right to use the service.
Article 9 - Termination
9.1 By the user
The user may close their account at any time from the application settings. Termination results in the deletion of the account and associated data within the time limits set out in the Privacy Policy.
9.2 By Oraklia Technologies SAS
Oraklia Technologies SAS reserves the right to suspend or terminate an account without notice in the event of:
- ·Breach of these Terms
- ·Abusive or fraudulent use of the service
- ·Non-payment (for premium subscriptions)
- ·Prolonged inactivity (more than 24 months)
Where abusive use is detected automatically (alert-triggering thresholds exceeded), the suspension is temporary and immediate: the user is notified in the application, together with its duration, and may contest it by writing to rgpd@five-angels.com. The account is reactivated automatically when the period ends.
Article 10 - Changes to the service
Oraklia Technologies SAS reserves the right to modify, suspend or discontinue all or part of the service at any time. In the event of a substantial change to the features or to these Terms, users will be informed at least 30 days in advance.
Article 11 - Governing law and jurisdiction
These Terms are governed by French law.
In the event of a dispute relating to the interpretation or performance of these Terms, and failing an amicable settlement within 30 days of notification of the dispute by either party, the dispute shall be submitted to the competent courts of the place where the registered office of Oraklia Technologies SAS is located.
